Charleston, W. Va., Thursday, March 15, 2012The Senate met at 11 a.m.

(Senator Kessler, Mr. President, in the Chair.)

    Prayer was offered by Bishop Joe Thomas, Nondenominational Fellowship Pentecostal Ministries, Charleston, West Virginia.

    Pending the reading of the Journal of Wednesday, March 14, 2012,

    On motion of Senator Stollings, the Journal was approved and the further reading thereof dispensed with.

    The Senate proceeded to the second order of business and the introduction of guests.

    The Senate then proceeded to the third order of business.

Executive Communications

    The Clerk then presented communications from His Excellency, the Governor, advising that on March 14, 2012, he had approved Enr. Committee Substitute for Senate Bill No. 100, Enr. Senate Bill No. 205, Enr. Senate Bill No. 214, Enr. Committee Substitute for Senate Bill No. 382, Enr. Senate Bill No. 385, Enr. Committee Substitute for Senate Bill No. 429, Enr. Committee Substitute for Senate Bill No. 434, Enr. Committee Substitute for Senate Bill No. 536, Enr. Committee Substitute for House Bill No. 2521, Enr.     The Senate proceeded to the fourth order of business.

    Senator Tucker, from the Joint Committee on Enrolled Bills, submitted the following report, which was received:

    Your Joint Committee on Enrolled Bills has examined, found truly enrolled, and on the 15th day of March, 2012, presented to His Excellency, the Governor, for his action, the following bills, signed by the President of the Senate and the Speaker of the House of Delegates:

    (Com. Sub. for H. B. No. 4063), Relating to civil service commissions in political subdivisions.

    (H. B. No. 4103), Consolidating of government services and enforcement of laws pertaining to the motor carrier industry.

    (H. B. No. 4119), Providing a definition for an athletic director who is employed by a county board of education.

    (Com. Sub. for H. B. No. 4307), Clarifying that the practice and procedure for domestic violence civil proceedings are governed by court rule.

    (Com. Sub. for H. B. No. 4332), Relating to transfer of service credit from Public Employees Retirement System to Emergency Medical Services Retirement System.

    (Com. Sub. for H. B. No. 4376), Licensing wine sales at certain professional baseball stadiums.

    (H. B. No. 4403), Changing the filing deadline for certified write-in candidates.

    (Com. Sub. for H. B. No. 4433), Modifying the criteria for awarding high school diplomas to certain veterans.

    (Com. Sub. for H. B. No. 4489), Strengthening authority of the West Virginia Municipal Pensions Oversight Board.

    And,

    (H. B. No. 4567), Permitting the Harrison county commission to levy a special district tax.

    The Senate proceeded to the fifth order of business.

Filed Conference Committee Reports

    The Clerk announced the following conference committee report had been filed at 11:13 a.m. today:

    Eng. Com. Sub. for Senate Bill No. 160, Budget Bill.

    Senator Unger then moved that the Senate adjourn until tomorrow, Friday, March 16, 2012, at 11 a.m.

    The question being on the adoption of Senator Unger’s aforestated motion, and on this question, Senator Unger demanded the yeas and nays.

    The roll being taken, the yeas were: Boley, Browning, Chafin, Edgell, D. Facemire, Fanning, Foster, Green, Helmick, Jenkins, Kirkendoll, Laird, McCabe, Miller, Minard, Nohe, Palumbo, Plymale, Prezioso, Snyder, Stollings, Tucker, Unger, Williams, Wills, Yost and Kessler (Mr. President)--27.

    The nays were: Barnes, Beach, K. Facemyer, Hall, Klempa, Sypolt and Wells--7.

    Absent: None.

    So, a majority of those present and voting having voted in the affirmative, the President declared Senator Unger’s motion had prevailed.

    In accordance with the foregoing motion, the Senate adjourned until tomorrow, Friday, March 16, 2012, at 11 a.m.
